Murder charges against rehab center are a first in California

Gary Benefield was in rough shape when a driver from the substance abuse treatment company A Better Tomorrow met him at the San Diego airport in 2010.

It was the day before his 53rd birthday. The longtime smoker had recently been hospitalized for pneumonia and was tethered to an oxygen tank, which he had relied on for years. He was seeking treatment for a drinking problem and had signed himself up for a round of detox and rehab.

Sometime that night, he collapsed by his bed at a Murrieta residential facility and died. The house manager, who was supposed to check on him regularly, had fallen asleep. Benefield’s body was found in the morning.

The family sued, reaching an out-of-court settlement.

What came next sent a jolt through California’s large drug and alcohol rehabilitation industry. The state attorney general’s office pursued second-degree murder charges against A Better Tomorrow and four of its employees — the first time in California history that a corporation had been accused of murder, according to the facility’s attorneys.

Kelly Strader, a professor at Southwestern Law School, said the attorney general’s office may have filed the charges as a warning to treatment facilities “that you’d better clean up your act. We’re going to take this very seriously.”

A 2012 report by the California Senate Office of Oversight and Outcomes, which outlined the four deaths at A Better Tomorrow, among others, said that the state had failed to police treatment homes, “with deadly results.”

We want to begin a new dialogue about how to expose the coercion of US citizens who get DUI’s, and told they must go to AA meetings, which is a violation of their First Amendment Rights. We want to  stop AA from being in our Courts and educate people about other free options like SMART RECOVERY, Moderation, SOS, Women for Sobriety and HAMS Harm Reduction and the Use of Naltrexone etc.

We want AA out of The FAA and extorting Pilots to go to AA meetings,  to AA rehabs to the tune of 40K a month because they have money, and forcing them to spend thousands of dollars to go to an AA Psychiatrist. Yes an AA member who is a psychiatrist and playing the AA game and making alot of money doing it.

We want to stop The Board of Nursing from sending Nurses to AA for 5 years.

We want AA members, or those coerced there to know that when they are sexually harassed in an AA meeting, that they have rights and they can do something about it.

There have been similar organizations that have gotten away with sexual assault crimes and preying on children for hundreds of years, that have since been attacked, sued and forced to change . These organizations were once untouchable. The Catholic Church and The Boy Scouts have helped many, yet still they needed to address sex offenders and deviants from using their organization for easy pickings. It was their Insurance carriers , not their caring about the protection of children that forced them to do this.

With the growth of the internet and a few powerful blogs like Orange Papers and Stinkin- Thinkin, things began to change in regards to AA and secrecy.

In 2008 a General Service Board member , Paul C.  wrote a 7 page letter http://stinkin-thinkin.com/wp-content/uploads/2011/07/ATTACHMENT_TO_TOPIC_002-PREDATORS.doc.pdf  to the General Service Board of Alcoholics Anonymous. They made him wait one year to read it to them. Then something happened that shocked not only Paul, but a couple of Board members … one that I interviewed for The 13th Step. They were shocked when the board asked the AA member team of paid employees to go to the AA US fellowship and ask them how they feel about such things.

They told the Board ” That’s not our job! ” The men that I knew who were inside for that meeting told me that after my 8 page letter arrived in October of 2009 they, the AA General Service Board voted to do nothing…. One man was in AA for 30 + years. These are really good men who were sickened by what they saw going in in NY AA Main Headquarters…these men who were on the board decided to leave AA .

All across America, including Los Angeles, Ohio, Fort Collins, Louisville , Kentucky, Bellingham ,Washington, I visited AA meetings with women who were harmed and we saw a pattern. Meetings once filled to capacity over with 300 now had 30. Meetings once filled with 110 pp, on a Friday  night , now had 10.

Most journalists I spoke to at first had no idea that AA was not run by a trained social worker or therapist. I was shocked by their idea that it was. I knew what AA was and what it wasn’t.

Then CBS 48 Hours aired. Boy did the shit storm happen on CBS 48 Hours FACEBOOK Page- Some AA members calling Maureen Maher all kinds of vicious names and comments that even shocked some of us. They went crazy calling Karla Brada parents names saying they were looking for Big bucks with their Law Suit against AA, which we know is not true. EVEN Marianne Williamson attacked Gabrielle Glaser on her FACEBOOK page when Gabrielle was on MSNBC. She was far from “spiritual” in her remarks.

If you are leaving AA, NA, or if you have left and have been harmed in any way, I would like to make a suggestion. Write your story of how and what happened in the shortest form  you can do. Think about anyone who is a professional in your town, be it a Therapist, Police Officer, Judge, Doctor, Lawyer, Educator, parole Officer. Tell your community how you were harmed.

There are many who silently Hate AA. There are many who claim AA saved their lives. We here know what AA really is…and what it isn’t.

There is a huge story trending now with the opiate addiction problem. I have pasted the link, but there are many other stories out  there. Please link the ones you like. I am pretty upset by this , yet I hope some good comes of it and not another WAR on DRUGS ….yikes….make Pot Legal everywhere, drop the drinking age back to 18 and they wont be stealing your opiate pills – then off to heroin. They will smoke some pot and have a beer. God forbid we Americans learn how to drink moderately.  🙂

White House officials announced Tuesday that they will seek nearly $1.2 billion in new federal funding over the next two years to address the growing problem of heroin and prescription opioid use, an epidemic that has become an increasingly important policy priority among the nation’s politicians.

The centerpiece of the proposal is $1 billion in mandatory funding over two years to expand access to treatment for prescription drug abuse and heroin use, $920 million of which would go to the states. Another $500 million, some of which is a continuation of existing funds, would support work by the departments of Health and Human Services and Justice to expand not just treatment but access to the overdose-reversal drug naloxone, and support targeted enforcement activities.

Here is my twist on it all.

There are many people who use pain medication properly and and do not abuse it. There are many sides to this problem. The problem with opiate addiction is coupled with the failure of the religious AA or 12 step dominated rehabs that fail miserably…and have for decades. Yes some people abuse these drugs, but saying Opiate Addiction is taking over the country and killing so many is absurd. I along with many have a real disease called CANCER. SOME 600,000 people will die from Cancer in the USA this year alone and over 2 Million will die throughout the world in one year. WHERE IS THE PUBLIC outcry about that? No — they would prefer to march with pink ribbons—–the breast cancer movement is a joke and almost as bad as the way AA has hijacked addiction treatment. The pink ribbon ladies have hijacked Breast Cancer Research and prefer to sit in Support groups and run 5 K walks/runs. I don’t think I will be joining them.

Yes some Doctors give too many pills, I too have received a bottle filled with Vicodin for a broken ankle when all I needed was 12 pills….not 30.   ( I don’t  have an issue or a problem with pills ) so I don’t get the abuse of it ….but… the rest of the world should not have to be penalized. Just listen to his wording– the senator speaking to the  President “The Addiction is going to rise up and consume this country?” http://www.huffingtonpost.com/entry/opioid-epidemic_us_56b26f25e4b08069c7a5ecb6 HMMMM sounds like Nixon, Regan, Bush and yes Harry Anslinger, our first Drug Czar who began our failed War On Drugs.

We need to provide real treatment.  That would be Doctors who are not pushing AA, Mental Health Professionals who are not pushing AA, a 1930’s religious self help group that is also not safe. I had a Father who was addicted , then stopped them for 17 years, and began again and lost everything he had and died in 2008. I know the heart ache of losing someone I loved to abuse of a substance. If I knew about non 12 step help, he may still be alive.

All the two hatter AA members who are making a killer on crap Sober Living, which is like a flophouse, crappy rehabs that charge $1,000 a day to be driven to a free AA meeting where violent offenders are waiting to prey, this is not Mental Health HELP. This is not   Medicine or Science. So when they are handing out the 1.2 Billion Dollars, I hope this money goes to the other 6 free options, that currently exist. I hope this money goes to free clinics we need where SMART Recovery, Harm Reduction, SOS, LifeRING, Women for Sobriety and Moderation, and The SINCLAIR Method are used with Cognitive Behavioral Therapy and Motivational Interviewing and can be used along with the psych meds that may be needed. I hope this money will also be used for Research. But I hear it’s only for treatment. Well that’s the other part of the problem. The treatment in America is 95 % Alcoholics Anonymous. A lay person, highly religious support group from 1935, that is unregulated, unsafe and has untrained, anonymous persons in charge. Yes there are leaders in Alcoholics Anonymous. They are on their General Service Board and they work in the NY office and their are delegates that work for free all over the Country.

I hope this money is used for new types of treatment that we know is working much better with young persons like Science and Kindness used at The Center for Motivation and Change, Practical Recovery, St Judes Retreats, The Baldwin Institute, Alternatives in Los Angeles and The Center for Optimal Living… hence Harm Reduction.

AA is infested in rehab to the tune of 30 Billion dollars already. Why does this industry need 1 billion dollars. Ill tell you why. Because those who are already running this Industry, who make big bucks DO NOT ….give BACK ….to help those with addiction disorders, but rather force their AA on everyone from the kid on the block who is shooting heroin, to the MOM hooked on Xanex, to …..the FAA, Pilots, The Board of Nursing, Nurses and Doctors and Lawyers who seek help from just abusing alcohol. The rehab INDUSTRY BUSINESS is already pushing this antiquated thing called  “Alcoholics Anonymous”.

Let’s move on and get 2015 science, medicine and therapy’s to help not only those with opiate addictions, but anyone caught up and/ or suffering with a Drug & Alcohol over use issue.

Say No to AA for a DUI – Stand up for 1st Amendment Rights

I think its that time of the year where many might find themselves being sent to AA.

Many have no idea that AA is not a government agency. That AA is not regulated by the state. That AA is not safe. That AA is not a drug treatment program . It’s a  group—- a fellowship….lay persons coming together.

So why are our courts sending EVERYONE to AA meetings for any violation and why are the Courts interconnected with rehabs, sober livings that are totally 12 step run. How long has this been going on? Since Drug court began in 1989? No ….it started before that , but when drug courts began it got oh so much worse.

 

Now in AA, some are there to help. Some are there to harm. Some are there to serve so they can stay “sober” ….AA style….. Some are there to take whatever they can and never give back.

But where’s the warning label for Alcoholic Anonymous? Like Cigarettes…one day an Insider who worked in the industry outed those guys. We think AA needs to be outed for who is there, who is sent there and who goes there to prey on innocent civilians.

Even though there is a “leader” or “secretary” who picks or is picked that day or the week before – they don’t necessarily lead unless its a cult group like the PG group-

Most AA members don’t feel  empowered to really lead for the most part.

When they read the preamble before every meeting — how come they don’t say

” AA is a drug /alcohol treatment program” . ..oh that’s right …That’s because it is not that. So what is AA really? Is it a fellowship? Then how can you get ordered to join a religious organization from a Judge? Is it a religion? TO some it is. It’s religious for sure.

Over 35 Courts have Deemed it so. Is it a Drug Treatment Program? No —-other wise it would need to be regulated by the state. But AA’s rehabs grandfathered themselves in way back when as something called ” NON Medical treatment and they are governed by The Department of Health? How is this going on ? Well it is.

So I guess the next question is how do we undo this. So if it’s not medical treatment how is Insurance paying for it . I mean rehab— 30 K a month- or $1,000 a day paid by Athem Blue Cross for Action Family where no medical anything is occurring…Just being bused to AA meetings. Just attending AA meetings. No doctors, no PhD’s, no groups let by real therapists? And maybe your daughter or son may be bused to a place where all the AA meetings are filled with men like Eric Earle, near trailer parks- connected to the DOC filled with not so wonderful not really AA members. That your Daughter or son may mix and mingle with these kinds of criminals.

We need to educate the public and stop the judges and the ab541 classes from sending people to AA for a DUI offense.

In the new year I will do a series to promote the six -free alternatives and some alternate Holistic, and for profit NON 12 step Alternatives.

What happens when one leaves AA and after a time wants to imbibe again, how some feel isolated, how some still want to remain abstinent, and why- and what one does with all the garbage in ones head after leaving.

We are no longer just blogging either. There are many Anti – or ex AA FACEBOOK pages for support. There are many good books to read to fill your mind with sane thinking and therapeutic solutions.

I also want to discuss how AA might have ruined your faith- are you atheist- and reconnecting with ones faith after leaving, and if you have a faith or religion that you practice. How AA ruins certain words and phrases and which phrases are charged for us after being in AA for a long time. Do we feel like we left a cult and why.

WOW is this a nice surprise. I don’t think I could ask for a nicer present then this one a sleepy, Sunday morning in California.

Jon Stewart,  who was an AA member for 14 years, left AA almost 2 years ago and we began to speak on Skype and through email. I had him on my radio show Blog talk radio Safe recovery , www.blogtalkradio.com/saferecovery and we finally met in person in May when we screened the film in London at The Mayfair  . It was like meeting an old friend from AA  who was now an ex stepper. We had many thoughts in common and some of his experiecne was very different from mine. He still feels AA saved his life and I never felt like that. I feel like I saved my life. But none the less, we agree on 90 % of everything else.

He is a super nice guy with alot of important stuff to say about change around alcohol over use…ect…

Kim Richards Sentenced in Target Shoplifting Case: Community Service, Probation and Alcoholics Anonymous

Kim Richards can officially move forward from her August arrest.

The former Real Housewives of Beverly Hills star was sentenced Wednesday in her Target shoplifting case.

A Los Angeles judge order that Richards, 51, complete 300 hours of community service, three years probation and 52 Alcoholics Anonymous meetings, according to court documents obtained by PEOPLE. TMZ was the first to report the news.

She must also “continue treatment and follow recommendations for treatment including drug rehabilitation, therapy and medications,” according to the papers.
